Data Processing Agreement (DPA)

Standard processor terms for Elan8 business customers.

1. Scope

This DPA applies when Elan8 processes personal data on behalf of a customer in connection with our services.

2. Roles

  • Customer acts as controller (or processor, as applicable).
  • Elan8 acts as processor for customer personal data.

3. Processing Instructions

Elan8 processes personal data only on documented customer instructions, unless required otherwise by applicable law.

4. Security Measures

Elan8 implements appropriate technical and organizational measures to protect personal data against unauthorized access, loss, alteration, and disclosure.

5. Confidentiality

Persons authorized to process personal data are bound by confidentiality obligations.

6. Subprocessors

Elan8 may engage subprocessors to provide services. Current subprocessors are listed on the Subprocessor List.

7. Assistance and Data Subject Rights

Elan8 provides reasonable assistance for data subject requests and compliance obligations, taking into account the nature of processing.

8. Incident Notification

Elan8 will notify the customer without undue delay after becoming aware of a confirmed personal data breach affecting customer data.

9. Return or Deletion

Upon termination of services, Elan8 will delete or return customer personal data in accordance with the agreement and legal obligations.

10. Precedence

In case of conflict between this DPA and the main service agreement, the DPA prevails for data protection matters.
