Terms for Elan8 accounts, trials, subscriptions and software.

1. Company information

Elan8 is a company established in the Netherlands. "Elan8", "we", "our" and "us" refer to Elan8 as provider of the services.

2. Scope

These Terms apply to our website, Elan8 accounts, trials, subscriptions, and the software we make available, including Doc42. Open-source software such as Spec42 is licensed under its own open-source license; these Terms do not restrict the rights that license gives you.

3. Your account

  • You need an Elan8 account to start a trial or a subscription. Open-source software needs no account.
  • Provide accurate information and keep your password and second factor confidential. You are responsible for activity under your account.
  • An account is personal: one person, not shared.
  • You can close your account from your account page. Closing switches off sign-in; see the Privacy Policy for what happens to your data.

4. Free trial

  • Each verified personal account can start one free 14-day trial of the Solo tools. No payment details are needed.
  • A trial ends automatically and never turns into a paid subscription.
  • A trial cannot be restarted after it ends or after paid use.

5. Solo subscription

  • Reseller. Subscriptions are sold by our online reseller and Merchant of Record, Paddle.com Market Ltd. Your purchase contract is with Paddle under Paddle's buyer terms; Paddle handles payment, invoicing, sales tax and payment-related support. Elan8 provides the software and services.
  • Price and billing. The price shown at checkout applies, including VAT where applicable. A subscription renews automatically each billing period until cancelled.
  • Early Access. Early Access is a beta offer at a reduced price. Its price stays the same for as long as your subscription continues. If you cancel and subscribe again later, the price at that time applies. We may stop offering Early Access to new subscribers at any time.
  • Included tools. A subscription gives access to the tools listed for your plan at the time of use. Doc42 is currently included. Tools in beta may change.
  • Cancellation. You can cancel at any time under Manage billing on your account page. Access continues until the end of the period you paid for; no further payments are taken.
  • Failed payments. If a renewal payment fails, access continues for seven days while the payment can be retried or your payment method updated. After that, paid access ends until the payment succeeds.
  • Refunds. If you are not satisfied, you can ask for a full refund within 14 days of your first payment for a subscription, without giving a reason. Renewal payments are not refunded: you can cancel at any time, and your access continues until the end of the period you have paid for. We also refund payments taken in error, such as a duplicate charge. Refunds are made by Paddle to your original payment method. A refunded or charged-back subscription ends immediately.
  • Withdrawal right. The 14-day refund above includes the statutory right of withdrawal consumers have for digital services. Nothing in these Terms limits your statutory rights.

6. Licenses for Elan8 software

  • While you have an active trial or subscription, you may use the included tools for your own work, on your own machines, under your personal account.
  • Elan8 tools check a signed license that we issue for your account. Licenses are verified offline; your models and documents are not sent to Elan8.
  • Do not share, resell, circumvent or tamper with licenses, and do not reverse-engineer closed-source Elan8 software except where the law allows it.
  • A Solo subscription is for one person. You may use the included tools on your own computers and in build pipelines that only build your own work. Teams and shared pipelines need a Business plan.

7. Acceptable use

  • Use the services in compliance with applicable law.
  • Do not abuse, disrupt, or attempt unauthorized access to the services.
  • Do not use the services to infringe third-party rights.

8. Your content

Your models, documents and other files stay yours. Elan8 tools process them on your machine; we do not receive them unless you send them to us, for example in a support request.

9. Beta services and support

Tools and offers marked beta or Early Access are under active development and may change or contain defects. We offer email support at support@elan8.com, in English or Dutch, and aim to reply within two business days. This is a target, not a guaranteed response time.

10. Availability and changes

We may change, suspend or discontinue parts of the services. We will tell subscribers about material changes to paid services in advance where reasonably possible. Offline licenses keep working for their stated validity during short outages of our services.

11. Liability

To the extent permitted by law, Elan8 is not liable for indirect or consequential damages. Any direct liability is limited to the amounts paid for the relevant service in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law, or rights consumers have under mandatory law.

12. Suspension and termination

We may suspend or close an account for breach of these Terms or misuse of the services. You may stop using the services and close your account at any time.

13. Changes to these Terms

We may update these Terms. For subscribers, material changes take effect at the next billing period after we have notified you; you can cancel before then.

14. Governing law

These Terms are governed by Dutch law. Disputes are submitted to the competent court in the Netherlands, unless mandatory law gives you another forum.
